Human rights and modernization of the Constitution of Ukraine

Abstract

The monograph chapter examines human rights as a fundamental legal and social value that determines the content and direction of a democratic state's activities. The essence of human rights and freedoms is revealed as inalienable opportunities necessary for ensuring a dignified existence, personal self-realization, and development. The chapter analyzes the role of constitutional and legal mechanisms for the implementation and protection of human rights as an important indicator of the development of civil society and the rule of law. The significance of human and civil rights and freedoms as the foundation of public authority, a means of participation in democratic processes, and a guarantee of individual independence is substantiated. It is emphasized that human rights constitute an integral part of national legal culture, serve as an important criterion of democratic state development, and represent one of the key factors in achieving sustainable development in contemporary society.

У розділі монографії досліджено права людини як фундаментальну правову та суспільну цінність, що визначає зміст і спрямованість діяльності демократичної держави. Розкрито сутність прав і свобод людини як невідчужуваних можливостей, необхідних для забезпечення гідного існування, самореалізації та розвитку особистості. Проаналізовано роль конституційно-правових механізмів реалізації та захисту прав людини як важливого показника становлення громадянського суспільства та правової держави. Обґрунтовано значення прав і свобод людини і громадянина як основи функціонування публічної влади, інструменту участі особи в демократичних процесах та гарантії її незалежності. Наголошено, що права людини є складовою національної правової культури, важливим критерієм демократичного розвитку держави та одним із ключових чинників забезпечення сталого розвитку сучасного суспільства.
