Поняття, завдання, предмет і система прокурорського права

Abstract

У розділі книги комплексно розкриваються теоретико-правові засади становлення та функціонування прокуратури як важливого інституту державної влади України. Проаналізовано історичні етапи розвитку прокуратури — від перших форм публічного обвинувачення в давніх державах до формування сучасної моделі прокуратури в Україні. Окрема увага приділяється впливу реформ Петра І на інституціоналізацію прокуратури в межах Російської імперії та становленню її як органу нагляду за додержанням законів. Обґрунтовується розуміння прокурорської діяльності як самостійної галузі державної діяльності, визначаються предмет, методи та система прокурорського права України як окремої галузі національного права. Розкрито роль і місце прокуратури в системі державних органів, її функції, повноваження та принципи організації й діяльності відповідно до положень Конституція України та Закон України «Про прокуратуру». Особливу увагу приділено понятійному апарату прокурорського права, правовим основам організації прокуратури, а також міжнародним стандартам діяльності органів прокуратури, зокрема принципам незалежності, законності, неупередженості та професійної етики. Розділ формує цілісне уявлення про теоретичні та практичні аспекти прокурорського права як складової правової системи України.

The book section comprehensively reveals the theoretical and legal foundations of the formation and functioning of the prosecutor's office as an important institution of state power in Ukraine. The historical stages of the development of the prosecutor's office are analyzed - from the first forms of public prosecution in ancient states to the formation of the modern model of the prosecutor's office in Ukraine. Special attention is paid to the impact of Peter I's reforms on the institutionalization of the prosecutor's office within the Russian Empire and its establishment as a body for supervising compliance with laws. The understanding of prosecutorial activity as an independent branch of state activity is substantiated, the subject, methods and system of prosecutorial law of Ukraine as a separate branch of national law are determined. The role and place of the prosecutor's office in the system of state bodies, its functions, powers and principles of organization and activity are revealed in accordance with the provisions of the Constitution of Ukraine and the Law of Ukraine "On the Prosecutor's Office". Special attention is paid to the conceptual apparatus of prosecutorial law, the legal foundations of the organization of the prosecutor's office, as well as international standards for the activities of prosecutorial bodies, in particular the principles of independence, legality, impartiality and professional ethics. The section forms a holistic understanding of the theoretical and practical aspects of prosecutorial law as a component of the legal system of Ukraine.
