Abstract

This chapter examines the special procedures in criminal proceedings involving state secrets. Based on Chapter 40 of the Criminal Procedure Code of Ukraine and the Law of Ukraine “On State Secrets,” it provides a detailed analysis of the procedures for classifying information as a state secret, determining its level of secrecy, and the rules for using such information in criminal proceedings. Special attention is paid to protecting state secrets during covert investigative and search operations, drafting motions by investigators and prosecutors, and judicial orders authorizing such actions. The chapter emphasizes the need for declassification after the completion of covert actions and the lawful use of classified information in court proceedings.
