Конституційні засади забезпечення права людини на здоров’я: порівняльно-правове дослідження

Abstract

The monograph chapter presents a comparative legal analysis of the constitutional regulation of the human right to health in Ukraine, the Czech Republic, and the Republic of Poland. It identifies common and distinctive features of the constitutional consolidation and practical implementation of this right within the examined legal systems, taking into account their specific constitutional and legal frameworks. Special attention is paid to the generalization of the Czech and Polish experience in ensuring the right to health, which allows for identifying effective approaches to its constitutional protection. Based on the analysis, proposals are formulated for improving Ukraine’s constitutional legislation in this area, particularly in strengthening guarantees of the right to health and enhancing the effectiveness of its protection mechanisms.
