Reflection of the essence of the social and legal value of a person in the normative law

Abstract

The monograph chapter examines the essence of the socio-legal value of the individual within normative jurisprudence. It is substantiated that the significance of the individual in the legal system is determined not only by the necessity of knowing the law but also by ensuring its implementation in accordance with human interests and needs through legal mechanisms. The concept of “human-centered” positive law is explored, with natural law serving as its foundational normative and value-based framework. It is emphasized that natural human rights constitute the basis for the humanization of law and serve as a criterion for evaluating and improving positive legal norms. The chapter underscores the need for their effective recognition and implementation within the national legal system.

У розділі монографії досліджено сутність соціально-правової цінності людини в нормативній юриспруденції. Обґрунтовано, що значення людини в правовій системі визначається необхідністю не лише знання закону, а й забезпечення його реалізації з урахуванням інтересів і потреб особи через правові механізми. Розкрито концепцію «людиноцентричного» позитивного права, основою якого має виступати природне право як універсальний нормативно-ціннісний орієнтир. Наголошено, що природні права людини є базисом гуманізації права, а також критерієм оцінювання та вдосконалення норм позитивного права. Підкреслено необхідність їх реального визнання та ефективної імплементації в національну правову систему.
