Встановлено, що основною проблемою є засудження осіб за порушення права, не захищеного Конвенцією та протоколами до неї. Визначено, що сьогодні існують громадські організації, що допомагають засудженим у процесі звернення до Суду. The article analyses international conventions that guarantee the rights and freedoms of convicts, lists the issues that arise during the use of international conventions and studies the practice of the European Court of Human Rights regarding convicts in Ukraine. It has been established that the main problem is the conviction of persons for violation of rights not protected by the Convention and its protocols. It is determined that at present there are public organizations that help convicts in the process of going to court. Having ratified the European Convention, Ukraine had undertaken to implement it in the national legal system. At the same time, the implementation of the norms of the Convention provides not only for the incorporation of its principles and ideas into the domestic system, but also for the implementation of the decisions of the ECHR taken in connection with the violation of the Convention by the State party. This is an inextricable link between the Convention and the decisions of the European Court of Human Rights. The Convention defines the activities of the European Court as a subsidiary mechanism for the protection of human rights and freedoms, the primary responsibility for which lies with national legal systems. With regard to the international protection of the rights of convicted persons under the Convention for the Protection of Human Rights and Fundamental Freedoms, in most cases the European Court of Justice protects the right of such persons to violate their rights to torture, inhuman or degrading treatment or punishment. punishments. The rights of prisoners to detention, the right to defence and the right to respect are increasingly being violated. Unfortunately, after 19 years of operation of the Convention in Ukraine, the problems still remained relevant. The Court itself emphasized that the rights to liberty and personal inviolability are constantly established by the Court in cases against Ukraine. It can be said that this international legal mechanism is one of the main and effective ones. The Convention regulates the establishment of such a body, assuming that a permanent European Court of Human Rights should be established to ensure compliance by the High Contracting Parties with their obligations under the Convention and its Protocols. Any of the High Contracting Parties may apply to the Court in any breach of the provisions of the Convention and its Protocols which it considers to have been committed by another High Contracting Party. Thus, all of the above indicates that the question of the availability of remedies at the national level, as well as the effectiveness of available remedies, is a priority dispute between the complainant and the respondent State at the stage of the review of the violation of the Convention. The legal position of the ECHR occupies a special place among the sources that guide national courts and other public authorities in their activities. They are the result of the interpretation of the rules of the Convention, as well as the attitude of the ECHR to certain legal problems. Thus, the practice of the European Court of Human Rights is actively used as part of the protection of the rights of convicted persons. Today, the practice of the European Court of Human Rights is actively used in national law enforcement practice in terms of ensuring the rights of convicted persons. There are various areas for ensuring the rights of convicted persons, such as the right to a fair trial, the prevention of torture, inhuman or degrading treatment or the like. This is a mechanism for ensuring the rights of convicted persons.
