Політичні права та свободи в умовах воєнного станув Україні: конституційні гарантії та виклики безпеці

Abstract

Стаття присвячена комплексному аналізу правових засад обмеження політичних прав і свобод в Україні в умовах воєнного стану, введеного у зв’язку з повномасштабною збройною агресією російської федерації. Досліджено конституційні межі допустимих обмежень прав громадян, а також їх відповідність міжнародним стандартам, зокрема Міжнародному пакту про громадянські й політичні права, Конвенції про захист прав людини і основоположних свобод, Женевським конвенціям та Римському статуту. Розглянуто механізми припинення політичної діяльності партій, обмеження виборчих процесів і мирних зібрань, а також збереження права на звернення як одного з прав, що не підлягає обмеженню навіть за надзвичайних умов. Проаналізовано практику реалізації обмежень на національному рівні, зокрема на підставі указів Президента України, рішень РНБО та чинного законодавства. Обґрунтовано, що законність, пропорційність та тимчасовість таких заходів є ключовими умовами для легітимності дій держави у сфері захисту національної безпеки. Зроблено висновки щодо потреби в підвищенні прозорості правозастосування й удосконалення правових механізмів судового та міжнародного контролю.

The article presents a comprehensive analysis of the legal framework governing the restriction of political rights and freedoms in Ukraine under martial law, introduced in response to the large-scale armed aggression of the Russian Federation. It examines the constitutional limits of permissible restrictions on citizens’ rights and their compliance with international standards, including the International Covenant on Civil and Political Rights, the Convention for the Protection of Human Rightsand Fundamental Freedoms, the Geneva Conventions, and the Rome Statute. The study explores the mechanisms for termination of political party activities, limiting electoral processes and peaceful assemblies, and preserving the right to petition as one ofthe non-derogable rights, even in emergency situations. The article analyzes the implementation of such restrictions at the national level, particularly on the basis of presidential decrees, decisions of the National Security and Defense Council of Ukraine, and current legislation. It substantiates that legality, proportionality, and temporariness are key conditions for the legitimacy of state actions in the sphere of national security protection. The article concludes with the need to enhance transparencyin law enforcement and to improve judicial and international oversight mechanisms.
