Право народу на законодавчу ініціативу як форма безпосередньої демократії

Abstract

У статті проаналізовано основні засади розуміння права народу у демократичному суспільстві, як ідея демократії та єдиний суб’єкт, якому належить вся влада в державі. Проте визначення на рівні Конституції України та Законів держави такої дефініції як базису створення української держави, на практиці знаходить свій прояв не зовсім всебічно і інколи, навіть, обмежено. Надаючи права реалізовувати владу народу через форми прямої та представницької демократії законодавець досить стримано розкриває саме прямі форми і щодо права народу контролювати своїх народних обранців, Президента України шляхом застосування механізмів відкликання, форм звітування, а отже політичної відповідальності, створює засади загрози демократії у суспільстві та політичної безпеки.

The article analyzes the basic principles of understanding the right of the people in a democratic society as the idea of democracy and the only entity that holds all power in the State. However, the definition at the level of the Constitution of Ukraine and the laws of the State of such a definition as the basis for the creation of the Ukrainian State, in practice, is not quite com prehensive and sometimes even limited. By granting the right to exercise the power of the people through the forms of direct and representative democracy, the legislator is rather restrained in disclosing the direct forms and, with regard to the right of the people to control their elected representatives, the President of Ukraine, through the use of recall mechanisms, forms of reporting, and, consequently, political responsibility, creates the basis for threats to democracy in society and political security.
