Митне оформлення товарів в умовах війни: нові правила

Abstract

У статті висвітлено особливості митного оформлення товарів в умовах війни, виходячи із реалій сьогодення. З’ясовано, що війна суттєво вплинула на зміни в організації роботи Державної митної служби України, що вимагало внесення відповідних змін у нормативно-правові документи та законодавчу базу України, які не тільки спрощують процедури митного оформлення товарів і транспортних засобів, але й надають певні переваги імпортерам. Розглянуто зміни у сфері митного оформлення товарів, внесені Постановою Кабінету Міністрів України «Деякі питання митного оформлення окремих товарів, що ввозяться на митну територію України у період дії воєнного стану». Виділено особливості виконання митних формальностей під час застосування спрощення «процедура випуску за місцезнаходженням». Розкрито зміни щодо електронної транспортної системи згідно з Угодою про використання митних декларацій та єдиної процедури транспортування та виявлено, що законодавчо закріплена можливість оформлення Т1 та використання NCTS для внутрішнього транзиту, оскільки для цілей цієї процедури передбачається застосовувати ті самі гарантії, що й до міжнародного застосування NCTS. Розглянуто особливості встановлення непреференційного походження товарів, що закріплені Законом України «Про внесення змін до Митного кодексу України щодо приведення порядку визначення країни походження товару у відповідність із Митним кодексом Європейського Союзу та забезпечення реалізації угод України про вільну торгівлю». З’ясовано, що пред’явлення митним органам товарів і транспортних засобів комерційного призначення під час митного оформлення за митними деклараціями, оформленими у звичайному порядку, буде обов’язковим у митному режимі експорту. Виявлено, що в умовах воєнного стану митні органи працюють більш інтенсивно, оскільки мають забезпечити максимально швидке оформлення товарів, у тому числі гуманітарного призначення.

The article highlights the peculiarities of customs clearance of goods in times of war, based on the realities of today. It is found that the war has significantly affected the changes in the organization of the State Customs Service of Ukraine, which required appropriate amendments to the regulatory and legal documents and the legislative framework of Ukraine, which not only simplify the procedures for customs clearance of goods and vehicles, but also provide certain advantages to importers. The changes in the field of customs clearance of goods introduced by the Resolution of the Cabinet of Ministers of Ukraine "Some Issues of Customs Clearance of Certain Goods Imported into the Customs Territory of Ukraine during the Period of Martial Law" are considered. The author highlights the peculiarities of customs formalities when applying the "release at location" simplification. The author reveals the changes in the electronic transport system under the Agreement on the Use of Customs Declarations and the Common Transport Procedure and reveals that the possibility of issuing T1 and using NCTS for internal transit is legally enshrined, since for the purposes of this procedure the same guarantees are supposed to apply as for the international use of NCTS. The author analyzes the peculiarities of establishing the non-preferential origin of goods enshrined in the Law of Ukraine "On Amendments to the Customs Code of Ukraine on Bringing the Procedure for Determining the Country of Origin of Goods in Accordance with the Customs Code of the European Union and Ensuring the Implementation of Ukraine's Free Trade Agreements". It has been established that the presentation of commercial goods and vehicles to the customs authorities during customs clearance under customs declarations issued in the usual manner will be mandatory in the export customs regime.
