Товарознавча ідентифікація критичного імпорту в умовах воєнного стану: баланс між спрощенням митних процедур та митною безпекою

Abstract

Механізм «критичного імпорту» інституціоналізований в Україні у 2022 році як реакція держави на необхідність стабілізації валютного ринку та забезпечення безперебійного ввезення стратегічно важливих ресурсів під час повномасштабної агресії. Метою впровадження механізму стало раціональне використання валютних резервів шляхом обмеження імпорту товарів, що не мають критичної важливості для економіки та життєзабезпечення. Перелік критичного імпорту змінювався відповідно до потреб економіки та оборонного сектору. Поняття «критичний імпорт» стало новим елементом регуляторної політики у світі, зокрема, ЄС під час енергетичної кризи 2022–2023, а в Україні набуло специфічної воєнної адаптації.

The critical import mechanism was institutionalized in Ukraine in 2022 as a government response to the need to stabilize the foreign exchange market and ensure the uninterrupted import of strategically important resources during a full scale aggression. The mechanism's implementation aimed to rationally use foreign exchange reserves by limiting the import of goods that are not critical to the economy and life support. The list of critical imports was modified in accordance with the needs of the economy and the defense sector. The concept of "critical imports" has become a new element of regulatory policy worldwide, particularly in the EU during the 2022–2023 energy crisis and in Ukraine, has acquired a specific military adaptation. Critical imports include goods vital for the economy, defense capability, energy security, and the social sphere, including defense equipment, medicines, construction materials, fuel and generators, and materials for critical infrastructure. Its distinctive features include strategic priority, simplified customs procedures, benefits, and enhanced commodity identification, ensuring the accuracy of product characteristics, proper classification, determination of customs value, and country of origin. It is noted that, under simplified customs control procedures, remote commodity identification based on electronic data, photo and video recording, electronic catalogs, and technical documentation is particularly relevant, increasing accuracy and speeding up clearance.
