Формування системи покарань у стародавньому світі

Abstract

Стаття присвячена історико-правовому аналізу становлення найдавніших способів впливу на злочинну поведінку та формування системи покарань. Проаналізовано еволюцію розвитку реакції на різні прояви злочинної поведінки та формування системи покарань у стародавньому світі. Автор акцентує увагу на тому, що злочином в цю добу було спричинення матеріальної шкоди, і завдання права зводилося до встановлення його розміру, методів його оцінки, способів і форм його спочатку своєрідної компенсації, а згодом – реальної оплати.

The article is devoted to the historical and legal analysis of the formation of the oldest methods of influence on criminal behavior and the formation of punishment in the ancient world. Author examines the evolution of development reactions to different forms of criminal behavior and form of punishment in the ancient world. The author emphasizes that the crime in this time was the inflicting of property damage and objectives of the law came down to the establishing of its size, methods of its assessment, methods and forms of its original compensation, and then the actual payment.
