Види слідчих (розшукових) дій-сучасні виклики та технології

Abstract

У ході дослідження виокремлено, що слідчі (розшукові) дії є важливим елементом у кримінальному провадженні, завдання якого полягає у виявленні, фіксації та перевірці доказів. Від того, наскільки точно будуть дотримані вимоги кримінального процесуального та іншого спеціального законодавства, залежить наскільки успішно буде проведене розслідування і наскільки справедливим виявиться вирок суду. Зазначено, що слідчі (розшукові) дії є значущою складовою реалізації завдань кримінального провадження визначених кримінальним процесуальним законодавством. Законодавством регламентується, що слідчі (розшукові) дії є діями, спрямованими на отримання (збирання) доказів або перевірку вже отриманих доказів у конкретному кримінальному провадженні. Так, до них належать наступні види: допит; пред’явлення для впізнання; огляд; ексгумація трупа; освідування особи; обшук; слідчий експеримент; проведення експертизи. Визначено, що процесуальною підставою слідчої (розшукової) дії, тобто процедурним виразом можливості (необхідності) її проведення, є рішення про її проведення, в якому викладаються, формулюються фактичні підстави – дані про можливості отримання відомостей про обставини кримінального правопорушення, що розслідується. Наголошено на особливостях проведення окремих слідчих (розшукових) дій в умовах воєнного стану. Розглянуто сучасні технології у розрізі здійснення слідчих (розшукових) дій. При цьому було наголошено, що новітні технології можуть значно удосконалити парадигму розслідування кримінальних правопорушень, надаючи потужні та ефективні засоби для виявлення та протидії злочинності.During the research, it was identified that investigative (search) actions are an important element in criminal proceedings, the task of which is to identify, record, and verify evidence. The successful conduct of the investigation and the fairness of the court verdict depend on how accurately the requirements of criminal procedural and other special legislation are followed. Therefore, it is important to provide conditions that will help conduct investigations in accordance with the requirements and protect against human rights violations, especially given the context in which Ukraine is now, namely the war and European integration. It is noted that investigative (search) actions are a significant component of the implementation of the tasks of criminal proceedings defined by criminal procedural legislation. Legislation regulates that investigative (search) actions are actions aimed at obtaining (collecting) evidence or verifying already obtained evidence in a specific criminal case. These include the following types: interrogation; identification lineup; inspection; exhumation of a corpse; examination of a person; search; investigative experiment; conducting expertise. It is determined that the procedural basis of the investigative (search) action, i.e., the procedural expression of the possibility (necessity) of its conduct, is a decision on its conduct, which sets out and formulates the factual grounds – data on the possibility of obtaining information about the circumstances of the criminal offense under investigation. Attention is focused on the features of conducting certain investigative (search) actions in conditions of martial law. Since such a question is extremely important in war conditions, the work of the investigator is complicated, so the introduction of new methods is necessary. Modern technologies in the context of conducting investigative (search) actions are considered. It was emphasized that modern technologies can significantly improve the paradigm of investigating criminal offenses, providing powerful and effective tools for detecting and combating crime.
