Форми контролю за дотриманням законності у діяльності органів місцевого самоврядування: досвід Франції

Abstract

У статті досліджується досвід Франції щодо співпраці та контролю між місцевими органами державної влади та органами місцевого самоврядування, визначаються їх сфери застосування, форми та види. Вона охоплює основні аспекти механізму контролю, які допомагають забезпечити законність та ефективність діяльності органів місцевого само врядування в країні. У процесі дослідження проблематики детермінації форм контролю за виконанням своїх функцій органами місцевого самоврядування вельми доречно сконцентрувати фокус дослідника на практичних засадах і досвіді Французької республіки, у якій вищезгадані засади визначаються саме як згідно з нормами і принципами ЄС, так і поряд з цим вони враховують внутрішні нормативно – правові акти і процедури, отже таким чином впорядковується механізм контролю за діяльністю місцевих органів влади, що покликані гарантувати і забезпечувати дотримання верховенства права і відповідності дій цих органів букві законів, норм і правил чинного законодавства. У період післявоєнного відновлення, трансформації до мирного життя, який охопив тривалий період відновлення в європейських країнах державних інститутів, його інфраструктури та апарату управління, заснування, розвиток та вдосконалення новітніх форм ефективної взаємодії місцевих органів влади та органів місцевого самоврядування забезпечує платформу розбудови та налаштування дієвої ефективної системи місцевих органів влади, яка кореспондується з кращими європейськими стандартами і може бути прикладом адаптації України до передових вимог і стандартів європейської інтеграції.

The article examines the French experience of cooperation and control between local public authorities and local self-government bodies, defines their scope, forms and types. It covers the main aspects of the control mechanism that help to ensure the legality and efficiency of local self-government in the country. In the process of studying the issues of determining the forms of control over the performance of their functions by local self-government bodies, it is very appropriate to focus the researcher’s attention on the practical principles and experience of the French Republic, where the above-mentioned principles are determined precisely in accordance with the EU norms and principles, and along with this, they take into account internal regulations and procedures, thus streamlining the mechanism of control over the activities of local authorities designed to guarantee and ensure the rule of law. In the period of post-war reconstruction, transformation to peaceful life, which covered a long period of restoration of state institutions, its infrastructure and management apparatus in European countries, the establishment, development and improvement of the latest forms of effective interaction between local authorities and local self-government bodies provides a platform for building and setting up an effective system of local authorities that is in line with the best European standards and can serve as an example of Ukraine’s adaptation to the advanced requirements and conditions and European integration. The author emphasizes that there are quite wide opportunities for decentralization of power, but at the same time notes that there are forms of control of state authorities over local self-government bodies in France. The following sections examine the role and functions of local governments, including executive bodies, elected bodies, and their relations with the central government. It then discusses the key aspects of the legal framework that contribute to the rule of law in local government. This includes constitutional and legislative guarantees governing the competencies, procedures, and responsibilities of local governments. Particular attention is paid to the principles of transparency, democracy, and separation of powers, which help to ensure the legitimacy and credibility of local governments.
