Linkedin Case & Other Perpetrations Abusing The Human Right to Privacy in a Digital World and Social Networking: Implications for Ukraine. Article 12. Universal Declaration of Human Rights the United Nations

Abstract

This article examines the challenges to the human right to privacy in the digital environment through the example of the LinkedIn platform. Referring to Article 12 of the Universal Declaration of Human Rights, the study highlights the importance of protecting individuals from arbitrary interference with their private life, correspondence, and reputation. The paper analyzes LinkedIn’s practices related to the collection and use of personal data, including the use of user information for advertising, profiling, and training generative artificial intelligence models. Particular attention is given to the issue of default consent mechanisms, where users’ personal data may be used unless they actively opt out. The article also reviews the regulatory response of the European Union, particularly within the framework of the Digital Services Act (DSA) and the Digital Markets Act (DMA), which aim to ensure a safer digital environment and protect users’ fundamental rights. The request for information sent by the European Commission to LinkedIn in April 2024 is discussed as an example of regulatory oversight regarding compliance with EU data protection and digital services legislation. The study considers the broader implications of such practices for digital governance and privacy protection, with particular relevance for Ukraine as it aligns its digital regulation and human rights standards with European norms.
