Протидія розслідуванню кримінальних правопорушень у сфері оподаткування: теорія та практика

Abstract

У запропонованій монографії розкрито генезис поняття протидії розслідуванню кримінальних правопорушень (злочинів) у сфері оподаткування та запропоновано визначення цього терміна. Виділено та згруповано типові форми та способи протидії розслідуванню кримінальних правопорушень у сфері оподаткування. Узагальнено основні фактори, що сприяють протидії розслідуванню кримінальних правопорушень у сфері оподаткування, шляхом їх систематизації. Охарактеризовано особливості використання слідчим спеціальних знань в умовах протидії розслідуванню. Конкретизовано та визначено тактичні прийоми проведення окремих слідчих дій в умовах протидії розслідуванню з боку зацікавлених осіб.

The proposed monograph reveals the genesis of the concept of counteraction to the investigation of criminal offenses (crimes) in the field of taxation and proposes a definition of this term. Typical forms and methods of counteraction to the investigation of criminal offenses in the field of taxation are identified and grouped. The main factors contributing to counteraction to the investigation of criminal offenses in the field of taxation are summarized by systematizing them. The features of the use of special knowledge by investigators in the conditions of counteraction to the investigation are characterized. Tactical methods for conducting individual investigative actions in the conditions of counteraction to the investigation by interested parties are specified and defined.
