Злочинність у сфері надрокористування

Abstract

У статті досліджуються теоретико-кримінологічні засади визначення та систематизації злочинності у сфері надрокористування. Розкрито сутність надрокористування як комплексної суспільно-правової діяльності, нерозривно пов’язаної з охороною та збереженням надр. Обґрунтовано доцільність розширеного підходу до визначення змісту злочинності у цій сфері, що охоплює не лише основні кримінальні практики, передбачені статтями 240, 244 та 298 Кримінального кодексу України, а й акцесорні та супутні злочини. Проаналізовано функціональне призначення техніко-забезпечувальних, корупційних і легалізаційних кримінальних практик, які сприяють відтворенню, поширенню та інституціоналізації злочинної діяльності у сфері користування надрами. Особливу увагу приділено взаємозв’язку незаконного видобування корисних копалин із порушеннями екологічної безпеки, забрудненням довкілля, знищенням природних ресурсів та об’єктів археологічної спадщини. Визначено місце злочинності у сфері надрокористування в системі екологічної та еколого-економічної організованої злочинності. Розкрито її системний характер, структурну складність і міжвидову природу. Сформульовано вузьке та широке розуміння злочинності у сфері надрокористування як об’єкта кримінологічного дослідження. Наголошено на необхідності комплексного підходу до її кримінологічного пізнання та запобігання, який враховує взаємозалежність екологічних, економічних, корупційних і безпекових складових.

The article examines the theoretical and criminological foundations for defining and classifying crime in the field of subsoil use. It explores the essence of subsoil use as a complex socio-legal activity intrinsically connected with the protection and preservation of mineral resources. The article substantiates the need for an expanded approach to defining the scope of crime in this field, encompassing not only the principal criminal practices provided for in Articles 240, 244 and 298 of the Criminal Code of Ukraine, but also ancillary and associated criminal activities. It analyzes the functional roles of technical-support, corruption-related and money-laundering criminal practices that facilitate the reproduction, expansion and institutionalization of criminal activity in the field of subsoil use. Particular attention is paid to the relationship between illegal mineral extraction and violations of environmental safety requirements, environmental pollution, the destruction of natural resources and archaeological heritage sites. The article identifies the place of crime in the field of subsoil use within the broader system of environmental crime and organized environmental-economic crime. Its systemic nature, structural complexity and cross-sectoral character are examined. Narrow and broad definitions of crime in the field of subsoil use as an object of criminological research are formulated. The article emphasizes the need for a comprehensive approach to criminological analysis and prevention that takes into account the interdependence of environmental, economic, corruption-related and security components.
