Вплив штучного інтелекту на реалізацію прав і свобод людини і громадянина в Україні

Abstract

The article analyzes individual issues of the influence of artificial intelligence as information technologies, with the application of which it is possible to carry out complex tasks by using a system of scientific research methods and information processing algorithms, which have a significant impact on the implementationof human and citizen rights and freedoms in Ukraine. The current state of regulatory support for the indicated problem in Ukraine, as well asissues that require the separatelegalregulation, areanalyzed.It is noted that the use of artificial intelligence technologies affects all spheres of social life, in particular, itis a component of ensuring information and cyber security in Ukraine. It was found that the following rights and freedoms are under particular threat due to the influence of AI: the right to respect for private and family life, freedom of expression, non-discrimination, the right to freedom of movement, the right to freedom and fair elections, the right to a fair trial. Ukraine does not stand aside from the processes of improving the legal regulation of artificial intelligence technologies and expresses its desire to occupy a significant segment of the world market of artificial intelligence technologies, leading positions in international rankings. Artificial intelligence technologies are expected to contribute to the transformation of the economy, the labor market, government institutions and society in general. Their application will provide an opportunity to reduce costs and increase production efficiency, as well as the quality of goods and services. The use of AI technologies must first of all protect the human right to dignity as a basic and fundamental human right, primordial for all other rights and freedoms, and the violation of any human rights in this way can be considered a violation of the right to human dignity. The emergence of threats to human rights in one form or another when using AI requires finding ways to overcome risks and threats to human rights and the proper functioning of the human rights protection and rights restoration mechanism.
