Особливості проведення судово-медичної експертизи в умовах воєнного стану

Abstract

The article considers the importance and specificity of the process of conducting a forensic medical examination under martial law. It quite clearly emphasizes the need to ensure justice and fairness during an armed military conflict on the territory of our state, when the collection of evidence is often complicated, and the need for very good professional analysis is constantly growing. The work emphasizes that forensic examinations should always play a key role in the process of documenting wartime criminal offenses, in the process of identifying the perpetrators and restoring the rights of victims, which is very important and very necessary for the establishment of international justice. The main material focuses on highlighting the specifics of conducting a forensic medical examination on the territory of Ukraine during martial law. Actually, the increase in the sophistication of criminal offenses, the increase in the amount of losses and the amount of harm caused, as well as very often new types of socially dangerous behavior. The article discusses new very important and significant legislative changes regarding the process of conducting a forensic medical examination. In addition, the article includes a separate consideration of the administrative-legal regulation of forensic expert activity, including material and technical equipment, legal support and the process of international legal interaction. The article specifically emphasizes the importance of state regulation and the importance of the process of national policy formation in the field of forensic expert activity. The article describes and lists all possible options for conducting forensic medical examinations, their specifics and professional features regarding their conduct. Certain regulatory legal acts that simplify the conduct of forensic medical examinations in martial law are considered. The exact sequence of actions of the employees of the Bureau of Forensic Medical Examination regarding the establishment of the fact of death during the war is given. During the war on the territory of our state, namely due to the effect of martial law, the conduct of forensic medical examination acquired certain features and faced a number of challenges, which are given in the article. The paper proposes a number of measures that can be implemented to improve the level of forensic medical examinations in the conditions of martial law in Ukraine.
