Кореляція міжнародного правопорядку та прав людини в сучасному міжнародному праві

Abstract

Стаття присвячена дослідженню взаємозв’язку міжнародного правопорядку та прав людини в сучасному міжнародному праві. Розглянуто наукові підходи до таких понять, як «світовий порядок», «міжнародний порядок», «міжнародний правопорядок», «права людини». У сучасних умовах міжнародних відносин проблеми забезпечення стабільності міжнародного правопорядку, в основу якого покладені основоположні принципи міжнародного права, зокрема й повага прав людини, потребують значних зусиль та активних правомірних дій держав як основних суб’єктів міжнародного права. Взаємозв’язок між правами людини та міжнародним правопорядком розглядається як одна із фундаментальних характеристик сучасної системи міжнародно-правового регулювання.

This article examines the relationship between the international legal order and human rights in contemporary international law. It explores academic approaches to concepts such as «world order», «international order», «international legal order», «human rights». In the current context of international relations, the challenges of ensuring the stability of the international legal order – which is founded on the fundamental principles of international law, including respect for human rights – require significant efforts and active, lawful actions by states as the primary subjects of international law. The interconnection between human rights and the international legal order is regarded as one of the fundamental characteristics of the modern system of international legal regulation. These two concepts form the basis of modern international law as the normative regulator of the system of international relations in the contemporary world. Neglecting one of these phenomena leads to an imbalance in the possibilities for peaceful coexistence, since human rights can be realized, ensured, and protected only when all actors adhere to the principles and norms of international law – which, in fact, constitute the international legal order.
