Теоретичні проблеми функцій сучасного конституційного права

Abstract

У статті розглядаються ключові теоретичні аспекти функцій сучасного конституційного права. Автор аналізує еволюцію уявлень про функції конституційного права, їх класифікацію, взаємозв’язок із принципами правової держави та демократичного управління. Особливу увагу приділено нормативно-регулятивній, охоронній, установчій, інтеграційній та прогностичній функціям. Порушуються проблеми узгодження теоретичних концепцій із практикою реалізації функцій у сучасних умовах трансформації правової системи України. Дослідження має як наукову, так і практичну цінність для правознавців та фахівців у галузі конституціоналізму.

The article examines the key theoretical aspects of the functions of modern constitutional law. The author analyzes the evolution of ideas about the functions of constitutional law, their classification, and their relationship with the principles of the rule of law and democratic governance. Particular attention is paid to the normative-regulatory, protective, constitutive, integration, and prognostic functions. The problems of harmonizing theoretical concepts with the practice of implementing functions in the modern conditions of the transformation of the legal system of Ukraine are raised. The study has both scientific and practical value for lawyers and specialists in the field of constitutionalism.
