Територія сучасної держави: поняття та функції (частина друга)

Abstract

У статті розкриваються змістовні та функціональні характеристики території як політико-правового інституту. Доводиться, що з феноменом території пов’язані практично усі фундаментальні явища державно-управлінського життя сучасних суспільства і держави. Територіальний ресурс, з одного боку, один із важливих компонентів процесу досягнення завдань, цілей та функцій держави, а з іншого - стратегічна ознака та важливий елемент механізму реалізації її суверенних прав. На думку автора, у своїй єдності, розглянуті у статті аспекти у розумінні сутності державної території, дозволяють говорити про існування даного феномену як фундаментального інституту політико-правового життя, який має аксіологічні, гносеологічні, онтологічні, цивілізаційні, інституціональні, конститутивні, нормативні, функціональні, історичні та інші параметри.

The article describes the content and functional characteristics of the territory as a political and legal institution. It is proved that practically all fundamental phenomena of the state and administrative life of modern society and the state are connected with the phenomenon of the territory. The territorial resource, on the one hand, is one of the important components of the process of achieving the tasks, goals and functions of the state, and on the other - a strategic feature and an important element of the mechanism for implementing its sovereign rights. In the author's opinion, in their unity, the aspects considered in the article in understanding the essence of the state territory allow us to speak about the existence of this phenomenon as a fundamental institution of political and legal life, which has axiological, epistemological, ontological, civilizational, institutional, constitutive, normative, functional, historical and other parameters.
