Захист та реалізація прав українських військовополонених в умовах сьогодення

Abstract

У статті досліджується питання захисту та реалізації прав українських військовополонених в умовах сьогодення. Зокрема зосереджується увага на дотриманні норм міжнародного та національного законодавства під час збройних конфліктів, що виникають у сучасному світі. Зазначено, що захист прав військовополонених, а особливо їх реалізація, умови утримання та своєчасне звільнення є нагальними питаннями, над якими наполегливо працює українська влада, дипломати та міжнародна спільнота. Зазначено на важливості проведення систематичної роботи щодо звільнення українців з ворожого полону. Констатується систематичність порушень росією норм міжнародного права, зокрема щодо поводження з військовополоненими. Окремо зазначається несприйняття росією окремих пропозиції та спроб врегулювання систем та заходів щодо обміну військовополоненими. Зазначено про необхідність стимулювання рф дотримуватися норм міжнародного гуманітарного права в поводженні з українськими військовополоненими, важелем у чому є міжнародна дипломатична та економічна ізоляція росії; наголошено на потребі домогтися безпрецедентного рівня консолідації міжнародної спільноти навколо засудження злочинів російського режиму через ухвалення нових резолюцій ООН, ОБСЄ та інших впливових міжнародних інституцій. Окреслено потребу активного залучення міжнародних судових інституцій до притягнення рф до відповідальності за воєнні злочини, злочини проти людяності та геноцид проти народу України. Зауважено на важливості ратифікованого Україною Римського статуту та механізмів притягнення до відповідальності військових злочинців, які варварськи відносяться до всього, що має прив’язок до України. Узагальнено, що держави та міжнародне співтовариство мають докладати постійних зусиль для зміцнення культури відповідальності та неухильного додержання принципів гуманності та людської гідності, навіть в умовах війни. Стверджується на доцільності здійснення систематичної роботи в напрямі розроблення нормативно правових актів міжнародного значення задля кращого реагування на подібні прояви військової агресії в світі, ґрунтуючись на досвіді російсько-української війни.

The article examines the issue of protection and realization of the rights of Ukrainian prisoners of war in today's conditions. In particular, attention is focused on compliance with the norms of international and national legislation during armed conflicts arising in the modern world. It was noted that the protection of the rights of prisoners of war, and especially their implementation, conditions of detention and timely release are urgent issues that the Ukrainian authorities, diplomats and the international community are working hard on. The importance of carrying out systematic work regarding the release of Ukrainians from enemy captivity was noted. Systematic violations of the norms of international law by Russia, in particular regarding the treatment of prisoners of war, are noted. Separately, Russia's non-acceptance of certain proposals and attempts to regulate systems and measures regarding the exchange of prisoners of war is noted. The need to stimulate the Russian Federation to comply with the norms of international humanitarian law in the treatment of Ukrainian prisoners of war was noted, the lever in which is the international diplomatic and economic isolation of Russia; the need to achieve an unprecedented level of consolidation of the international community around the condemnation of the crimes of the Russian regime through the adoption of new resolutions of the UN, OSCE and other influential international institutions is emphasized. The need for active involvement of international judicial institutions in bringing the Russian Federation to justice for war crimes, crimes against humanity and genocide against the people of Ukraine is outlined. The importance of the Rome Statute ratified by Ukraine and the mechanisms for bringing to justice war criminals who are barbaric towards everything connected to Ukraine was noted. It is summarized that the states and the international community should make constant efforts to strengthen the culture of responsibility and unwavering adherence to the principles of humanity and human dignity, even in conditions of war. It is affirmed the expediency of carrying out systematic work in the direction of the development of normative legal acts of international importance for a better response to similar manifestations of military aggression in the world, based on the experience of the Russian-Ukrainian war.
