Організаційно-правові засоби боротьби з контрабандою

Abstract

This article examines the issues of legal and organizational means of combating smuggling, conducts research on smuggling as a phenomenon of illegal and socially dangerous, which threatens the economic interests of the country, public safety, morality, safety of life, public health, national security state regulation of foreign economic activity, causes direct economic losses to the state related to non-payment of customs duties and other taxes (payments) both during movement across the customs border of Ukraine and in connection with the sale of contraband goods on the territory of Ukraine or abroad, causes damage to the established order of government, encroaches on the national cultural heritage of the Ukrainian people, may damage Ukraine’s relations with other states. Statistical data on smuggling are studied, which indicate an increase in the number of smuggling, the spread of this phenomenon in Ukraine and a qualitatively new nature of the act. The impact on the economic security of Ukraine is highlighted, as well as the organizational and economic measures that need to be taken to effectively combat the development of smuggling activities in border areas in the context of strengthening the economic security of the state. It is established that the main factors that create favourable conditions for smuggling are: insufficient coordination of law enforcement and control bodies of Ukraine with the relevant authorities of neighbouring countries to exchange information on combating the movement of goods outside customs control or concealment from customs control. It is proposed to effectively combat smuggling to develop regulations to improve coordination and cooperation between customs and law enforcement agencies of Ukraine, as well as to update the regulatory framework governing the detection and prevention of smuggling and violations of customs regulations
