Участь викривача у кримінальному провадженні: питання нормативної регламентації

Abstract

Стаття присвячена дослідженню питань участі викривача у кримінальному провадженні у досудовому розслідуванні, забезпечення безпеки викривача, вирішенню питання про виплату викривачу винагороди. Зазначено, що особливістю кримінально-процесуального статусу викривача є те, що він має право отримати не тільки витяг з ЄРДР (як заявник), але й копію повідомлення Національному агентству з питань запобігання корупції про початок досудового розслідування за участю викривача, підставу початку досудового розслідування та інші відомості, передбачені ч. 5 ст. 214 КПК України. Відзначено неправильність того, що викривач не є суб’єктом касаційного оскарження судового рішення в частині, що стосується його інтересів під час вирішення питання виплати йому винагороди як викривачу. Розглянуто проблеми реалізації права викривача на конфіденційність і анонімність; зазначено, що сторона обвинувачення зобов’язана не допускати розкриття даних про особу викривача або інших відомостей, які дають змогу особам, чиїх дій або бездіяльності стосуються повідомлені викривачем факти, ідентифікувати його.

The scientific article is devoted to the research of issues of participation of whistleblower in criminal proceedings during pre-trial investigation, ensuring the protection of the whistleblower and providing monetary award to whistleblower. It is stated that the peculiarity of the criminal procedural status of the whistleblower is that he has the right not only to obtain an extract from the URPI (as an applicant), but also a copy of the report to the National Agency on Corruption Prevention on the commencement of a pre-trial investigation with the participation of the whistleblower, grounds for initiating a pre-trial investigation, other information provided in Part 5 of Article 214 of the Criminal Procedural Code of Ukraine. We carried out an establishment of the wrong statement that he whistleblower is not the subject of a court of cassation in the part concerning his interests in resolving the issue of payment of a monetary award to him as a whistleblower. The article considers the problems of exercising the right of the whistleblower to confidentiality and anonymity and the issues of complying obligations by the prosecution of non-disclosure the identity of the whistleblower or other information that allows persons whose actions or inactions relate to the facts reported by the whistleblower to identify him.
