Приватно-правові засади захисту прав людини у соціальній державі

Abstract

У монографії здійснено аналіз теоретико-правових засад захисту прав людини у соціальній державі. Зосереджено увагу на понятійно-категоріальному апараті, механізмі приватно-правового захисту прав людини, міжнародному та зарубіжному досвіді захисту таких прав. Акцентовано увагу на особливостях окремих форм захисту прав людини у соціальній державі, проаналізовано судову практику, неюрисдикційні форми захисту, самозахист, договірні форми захисту прав та законних інтересів людини і громадянина. Визначено гарантії та способи захисту прав людини в окремих сферах правовідносин: соціального забезпечення, у сфері інтелектуальної власності, житловій сфері, захисту прав споживачів. Проаналізовано здійснення права на захист учасниками сімейних відносин, визначено окремі аспекти нотаріального та судового захисту спадкових прав громадян. Досліджено систему гарантій захисту прав людини у приватних відносинах, що виникають у звʼязку з наданням медичних послуг. Призначений для здобувачів вищої освіти, викладачів, аспірантів, докторантів, практичних працівників, працівників судових органів, третейських суддів, адвокатів, нотаріусів, а також усіх, хто досліджує приватно-правові засади захисту прав людини у соціальній державі.

The monograph analyzes the theoretical and legal framework for the protection of human rights in the welfare state. Attention is focused on the conceptual and categorical apparatus, the mechanism of private legal protection of human rights, international and foreign experience of protection of such rights. The author emphasizes the peculiarities of certain forms of human rights protection in the welfare state, analyzes the judicial practice, non-jurisdictional forms of protection, self-defense, and contractual forms of protection of rights and legitimate interests of a person and a citizen. The author identifies guarantees and methods of human rights protection in certain areas of legal relations: social security, intellectual property, housing, and consumer protection. The author analyzes the exercise of the right to protection by participants in family relations, and identifies certain aspects of notarial and judicial protection of citizens' inheritance rights. The system of guarantees for the protection of human rights in private relations arising in connection with the provision of medical services is investigated.
