Соціальна цінність жінки в контексті розвитку доктрини права

Abstract

У статті розглядаються питання соціальної цінності жінки в контексті розвитку доктрини права. Наголошується, що з’ясування сутності соціальної цінності жінки нерозривно пов’язано з існуючими теоретичними підходами праворозуміння, які відіграють важливу роль в процесі визначення подальших шляхів удосконалення законодавства, нормативного закріплення форм участі жіноцтва у функціонуванні громадянського суспільства та розбудові правової держави. Підкреслюється, що на різних історичних етапах свого існування позитивістський тип праворозуміння був представлений, по-перше, у формі жорстко го позитивізму, який передбачав тотальний контроль держави над суспільством та повне нехтування правами і свободами людини; по-друге - м’якого позитивізму, особливістю якого було формальне визнання прав та свобод людини та включення в нього деяких ідей природного права; по третє - конвергенції юридичного позитивізму і теорії природного права, що створює сприятливі умови для розвитку правової системи України, активної участі жіноцтва у процесі розбудови державно-правових інституцій та життєдіяльності суспільства в цілому.

The article examines the issues of the social value of women in the context of the development of the doctrine of law. It is emphasized that the clarification of the essence of the social value of women is inextricably linked with the existing theoretical approaches to legal understanding, which play an important role in the process of determining further ways to improve legislation, normative consolidation of forms of women's participation in the functioning of civil society and the development of a legal state. It is emphasized that at different historical stages of its existence, the positivist type of legal understanding was presented, firstly, in the form of hard positivism, which assumed total state control over society and complete disregard for human rights and freedoms; secondly, soft positivism, the peculiarity of which was the formal recognition of human rights and freedoms and the inclusion of some ideas of natural law in it; thirdly, the convergence of legal positivism and the theory of natural law, which creates favorable conditions for the development of the legal system of Ukraine, the active participation of women in the process of building state and legal institutions and the life of society as a whole.
