Проблеми правового регулювання етичної поведінки в правоохоронних органах

Abstract

У статті досліджуються проблеми правового регулювання етичної поведінки працівників правоохоронних органів України як одного з ключових чинників підвищення довіри суспільства до інституцій правопорядку. Акцентовано увагу на значенні етичних норм у формуванні професійної культури поліцейських, прокурорів, співробітників Служби безпеки України, Державного бюро розслідувань та інших органів, що здійснюють правоохоронну діяльність. Проведено детальний аналіз чинної нормативної бази, зокрема положень Конституції України, Законів України «Про Національну поліцію», «Про прокуратуру», «Про Службу безпеки України», Дисциплінарного статуту та Кодексу етики поліцейського. Автор наголошує на фрагментарності існуючих етичних стандартів, відсутності єдиного етичного кодексу для всіх категорій правоохоронців та недостатній ефективності чинних документів у практичному застосуванні. У статті підкреслено відсутність єдиних підходів до формування та реалізації етичної політики в різних силових структурах, що призводить до нерівномірного правозастосування та зниження стандартів професійної поведінки. Розглядається проблема інституційної слабкості механізмів контролю за дотриманням етичних норм, зокрема брак незалежних органів нагляду, прозорості дисциплінарних процедур та ефективних каналів зворотного зв’язку з громадськістю. Окремий розділ статті присвячено вивченню міжнародного досвіду етичного регулювання в правоохоронних органах, зокрема моделі незалежного нагляду в США (наприклад, Civilian Review Boards), кодексів честі поліції Великобританії, систем етичного контролю в країнах Європейського Союзу та Скандинавії. Проведено порівняльно-правовий аналіз, що дозволяє виокремити кращі практики, придатні для адаптації в українських умовах. Автор звертає увагу на важливість незалежного інституційного контролю, наявності превентивних освітніх програм, публічного звітування та участі громадськості у формуванні етичної політики правоохоронних органів.

The article examines the problems of legal regulation of ethical behavior of law enforcement officers of Ukraine as one of the key factors in increasing public trust in law enforcement institutions. The emphasis is on the importance of ethical norms in the formation of the professional culture of police officers, prosecutors, employees of the Security Service of Ukraine, the State Bureau of Investigation and other bodies engaged in law enforcement activities. A detailed analysis of the current regulatory framework is carried out, in particular the provisions of the Constitution of Ukraine, the Laws of Ukraine “On the National Police”, “On the Prosecutor’s Office”, “On the Security Service of Ukraine”, the Disciplinary Statute and the Code of Ethics of a Police Officer. The author emphasizes the fragmentation of existing ethical standards, the absence of a single ethical code for all categories of law enforcement officers and the insufficient effectiveness of current documents in practical application. The article emphasizes the lack of unified approaches to the formation and implementation of ethical policy in various law enforcement agencies, which leads to uneven law enforcement and a decrease in standards of professional behavior. The problem of institutional weakness of mechanisms for monitoring compliance with ethical norms is considered, in particular, the lack of independent supervisory bodies, transparency of disciplinary procedures and effective channels of feedback to the public. A separate section of the article is devoted to the study of international experience in ethical regulation in law enforcement agencies, in particular, the model of independent supervision in the USA (for example, Civilian Review Boards), codes of honor of the police of the UK, systems of ethical control in the countries of the European Union and Scandinavia. A comparative legal analysis is conducted, which allows to identify the best practices suitable for adaptation in Ukrainian conditions. The author draws attention to the importance of independent institutional control, the availability of preventive educational programs, public reporting and public participation in the formation of ethical policy of law enforcement agencies.
