Правові спеціально-кримінологічні заходи протидії злочинності у сфері надрокористування в Україні

Abstract

Стаття присвячена дослідженню правових заходів запобігання кримінальному надрокористування на рівні спеціально-кримінологічного запобігання. Наголошено на необхідності створення правових умов для функціональної інтеграції кримінологічної та екологічної політик держави. Запропоновано шляхи кримінологічної специфікації Основних засад (Стратегії) державної екологічної політики України на період до 2020 року, а також системи стратегічної екологічної оцінки. Відстоюється думка про необхідність запровадження кримінологічної експертизи проектних рішень у сфері спеціального природокористування. Наголошено на необхідності удосконалення кримінально-правової охорони відносин у цій сфері.

The article is devoted to examination of legal counteracting measures to criminal subsoil use on the level of special-criminological prevention. It emphasizes the necessity of creating legal conditions for functional integration of criminological and ecological state policies. It proposes ways of criminological specification of the Main bases (Strategy) of state ecological policy of Ukraine for the period up to 2020 and criminological support of strategic ecological assessment. It supports an idea of the urgency of promoting the institute of criminological expertise of design solution in the sphere of special environmental management, assessing the impact of business activity designs on environment and also an idea of criminological ineffectiveness of resumption of moratorium on scheduled auditing subjects of subsoil use. The article substantiates the necessity of enhancing legal procedures for acquiring special permits for raw ember extraction, namely: a) streamlining procedures for acquiring special permits that should be implemented on the level of collaboration between the prospector and local self-government bodies; b) terminating legal requirement on mandatory legal status of a business entity for prospectors; c) reducing the cost of special permits; d) providing legal obligation to of complete submission of extracted raw ember to the state at prices not lower than current black market prices; e) providing legal mechanisms for channelling funds acquired from authorization of special permits to promting raw ember extraction to remediation of land. The article emphasizes the necessity of enhancing criminal-legal protection of relationship in the sphere of sustainable subsoil use. It works out proposition for amending and supplementing the Criminal code of Ukraine aimed at providing special criminalization of group forms of illegal subsoil use as well as illegal purchasing, storage and sale of knowingly illegally extracted subsoil of national importance. The article proposes measures for enhancing legal regulation of prospecting works, excavations on the objects of archaeological heritage through regulating activity on expansion and use of private archeological collections, elaboration of legal mechanism on assigning/acquiring special permits for prospecting works, excavation and reporting finding of archeological objects.
