Теоретичні засади економічної безпеки держави як правової категорії

Abstract

Стаття присвячена темі безпеки, важливому питанню розвитку нашої держави. Вважаємо, що сьогодні особливу увагу необхідно приділяти економічному розвитку та формуванню концепції економічної безпеки держави. Особлива увага в цьому дослідженні приділяється формуванню теоретичних основ економічної безпеки держави як правової категорії. У статті зазначено, що вивчення виключно історичного аспекту розвитку економічної безпеки унеможливлює розуміння сутності цього питання. Тому необхідно встановити його зв’язок з іншими категоріями, зрозуміти його історичну роль і механізм розвитку. У цьому аналізі варто зазначити, що термін «економічна безпека» поєднує два поняття: «економіка» та «безпека». Визначено, що порушення економічних інтересів фізичних та юридичних осіб істотно впливає на економічну безпеку держави. Висвітлено перешкоди економічному розвитку держави. Доведено, що загрози національній економічній безпеці України потребують ретельного аналізу та вдосконалення правових норм у цій сфері. Підтверджується, що особливу роль у структурі правових засад реалізації державної економічної політики відіграють адміністративно-правові норми, які є основою адміністративно-правового регулювання та дають змогу уповноваженим суб’єктам здійснювати державну політику у сфері економічної безпеки. Зроблено висновок, що економічну безпеку держави варто розглядати як такі умови економічного розвитку, за яких події, зовнішні та внутрішні процеси (не тільки економічні, а й політичні), виникнення форс-мажорних обставин дозволили б економічній системі продовжити свою прогресивність, розробку та забезпечення реалізації соціально орієнтованої політики. За результатами цього дослідження зроблено висновок, що основним напрямом діяльності нашої держави у напрямку забезпечення економічних інтересів має стати розробка та затвердження національної стратегії у сфері економічної безпеки.

The article is devoted to the topic of security, an important issue of the development of our state. We believe that nowadays a special attention should be paid to the economic development and formation of the concept of state economic security. A particular attention in this study is paid to the formation of theoretical foundations of economic security of the state as a legal category. The article states that the study of exclusively historical aspect of the development of economic security makes it impossible to understand the essence of this issue. That is why it is necessary to establish its connection with other categories, to understand its historical role and mechanism of development. In this analysis, it should be noted that the term «economic security» combines two concepts «economy» and «security». It is determined that the violation of economic interests of individuals and legal entities significantly affects the economic security of the state. The obstacles to the economic development of the state are highlighted. It is proved that the threats to the national economic security of Ukraine require careful analysis and improvement of legal norms in this area. It is confirmed that administrative and legal norms play a special role in the structure of legal bases of state economic policy implementation, which are the basis of administrative and legal regulations and enable authorized subjects to pursue state policy in the field of economic security. It is concluded that the economic security of the state should be considered as such conditions of economic development in which events, external and internal processes (not only economic but also political), the emergence of force majeure would allow the economic system to continue its progressive development and ensure implementation of socially oriented policy. The findings of this study concluded that the main focus of our state in the direction of ensuring economic interests should be the development and approval of a national strategy in the field of economic security.
