Дослідження у сфері порівняльної історії права у працях Ф.В. Тарановського

Abstract

Наукова стаття присвячена з’ясуванню змісту проведених Ф. Тарановським досліджень у сфері порівняльної історії права. Доведено, що вони містять відображення теоретико-методологічних засад порівняльної історії права. Встановлено, що праці Ф. Тарановського були спрямовані на пошук універсальних законів правової еволюції народів і держав світу; учений намагався відтворити в них ідею про стадіальний розвиток права; порівняльно-історичний метод застосовано ним у широких масштабах із метою виявлення в основному подібних рис у правових інститутах різних народів і держав.

The research article is dedicated to the explanation of the content of F. Taranovsky studies in the field of the comparative history of law. It is proved that they consist of reflections as of theoretical and methodological foundations of the comparative history of law. It is established that the works of F. Taranovsky aimed at finding universal laws of legal evolution of the nations and states of the world; the scientist tried to reproduce in them the idea of the stage development of law; the comparative-historical method has been applied by him on a large scale to identify similar features in the legal institutions of different nations and states.
