Зарубіжний досвід застосування судового прецеденту як джерела права

Abstract

The article considers the legal nature of case law in the countries of Anglo-American and continental law, the history of precedent as a source of law. The possibility of applying the court decisions of the European Court of Human Rights in the proceedings of Ukraine is indicated. The concepts, basic classifications of court precedents, and also features of their application are defined. Arguments are formulated that allowed to draw conclusions and determine the advantages and disadvantages of the application of judicial precedent.
