Впровадження судового прецедента у кримінальний процес України

Abstract

У монографії охарактеризовано впровадження судового прецедента у кримінальний процес України. Проаналізовано історичний розвиток та світовий досвід запровадження і використання судового прецеденту як одного із повноцінних джерел права. Визначено правові основи значення та змісту судового прецеденту в кримінальному процесі України. Визначено перспективи запровадження судового прецеденту в Україні.

This publication describes the introduction of a judicial precedent in the criminal process in Ukraine. The historical development and world experience of introduction and use of the judicial precedent as one of the full sources of law are analyzed. The legal foundations of the meaning and content of the judicial precedent in the criminal process of Ukraine are determined. The prospects of the introduction of a judicial precedent in Ukraine are defined.
