| dc.description.abstract | У статті здійснено аналіз поняття корупції та її особливості в сфері національної інфраструктури, геопросторових даних, земельних відносин та землеустрою. Закцентовано увагу на діяльності Державної служби України з питань геодезії, картографії та кадастру, його посадових осіб як суб’єкта корупційних проявів (суб’єкта кримінальних корупційних правопорушень та правопорушень пов’язаних з корупцією). Наголошено, що особливою сферою розповсюдження корупції є сфера національної інфраструктури, геопросторових даних, земельних відносин та землеустрою. Розповсюдження корупційних проявів у названій сфері прямо пов’язується із діяльністю майже усіх інституцій, оскільки їх більшість виступає суб’єктами земельних (інших, перелічених вище) відносин. У наведеному контексті варто погодитися із тими вченими, котрі наголошують, що запобігання та протидія корупції в такій сфері не може бути ізольованою. Наведена діяльність має стати частиною цілеспрямованого впливу на таке негативне явище у межах комплексної національної політики доброчесності (нетерпимості до корупційних проявів). Здійснено типологізацію корупційних проявів в аналізованій сфері, а саме: за сферою, формою корупції та факторами ризику: – у діяльності Держгеокадастру України (підкуп посадових та правоохоронних органів: хабарництво і пошук корупційної ренти посадовими особами для надання земельної інформації, послуг та дозволу на розробку, висновку, затвердження документації із землеустрою та реєстрації землі; фаворитизм та кумівство при прийнятті рішень посадовими особами Держгеокадастру України; захоплення земель через механізми безоплатної приватизації землі; маніпулювання та несанкціоноване втручання до поземельних книг, земельних ділянок винесення рішень, вирішення суперечок на користь впливових осіб та інвесторів; – маніпуляція з оцінкою землі для забезпечення вищих цін та/або заниження сум виплати компенсацій, офіційних платежів; шахрайство та виготовлення фальшивої документації на землю; розкрадання державних фінансів для виконання землевпорядних робіт та доходів від землі посадовими особами та політиками; використання державних підприємств як платформи для приватної практики (інженерами-геодезистами та інженерами-землевпорядниками); зловживання під час публічних закупівель): невідповідні земельні закони та процедури; надмірна або неоприлюднена плата за земельні послуги; відсутність визнання прав на землю: нерозвинена та непрозора система реєстрації земель; відсутність сучасних та точних земельних записів; існування численних органів землеустрою; нерегулярні практики збору земельних податків; обмежена доступність послуг; відсутність ефективних механізмів оскарження та незалежного нагляду; відсутність кодексу поведінки, тощо. The article analyzes the concept of corruption and its features in the field of national infrastructure, geospatial data, land relations and land management. Attention is focused on the activities of the State Service of Ukraine for geodesy, cartography and cadastre, its officials as subjects of corruption (subjects of criminal corruption offenses and offenses related to corruption). It was emphasized that a special sphere of the spread of corruption is the sphere of national infrastructure, geospatial data, land relations and land management. The spread of corruption in the mentioned sphere is directly related to the activities of almost all institutions, since most of them are subjects of land (other, listed above) relations. In this context, it is worth agreeing with those scientists who emphasize that the prevention and counteraction of corruption in such a field cannot be isolated. This activity should become part of a targeted impact on such a negative phenomenon within the framework of a comprehensive national policy of integrity (intolerance to corruption manifestations). The typology of corruption manifestations in the analyzed sphere was carried out, namely: by sphere, form of corruption and risk factors: – in the activity of the State Geocadastre of Ukraine (bribery of officials and law enforcement bodies: bribery and corruption rent-seeking by officials for providing land information, services and permission for development, conclusion, approval of documentation on land management and land registration; favoritism and nepotism in decision-making by officials of the State Geocadastre of Ukraine; seizure of land through mechanisms of free land privatization; manipulation and unauthorized interference with land registers, land plots, decision-making, resolution of disputes in favor of influential persons and investors - manipulation of land valuation to ensure higher prices and/or underestimation of compensation payments, official payments, fraud and production of false documentation for land, embezzlement of public finances for land management works and income from land by officials and politicians; use of state-owned enterprises as a platform for private practice (by surveying engineers and land management engineers); abuses during public procurement): inappropriate land laws and procedures; excessive or undisclosed fees for land services; lack of recognition of land rights: underdeveloped and opaque land registration system; lack of modern and accurate land records; the existence of numerous bodies of land management; irregular land tax collection practices; limited availability of services; lack of effective appeal mechanisms and independent oversight; lack of code of conduct, etc. | |
