Кримінально-правова характеристика хабарництва

Abstract

Bribery is one of the oldest crimes known to mankind. This type of corruption is a topical problem, in particular a criminal law problem. According to the Law of Ukraine "On Combating Corruption", taking a bribe is one of the forms of corruption. For the state, the problem under consideration acquires a paramount importance in terms of the need to solve it, because one of the main negative consequences of corruption is that the law does not solve its original social purpose. In conditions of intensive development of various corruption manifestations, the law does not perform the most important function aimed at ensuring the realization of the rights and legitimate interests of each person. Instead, the law is used as a means by which individuals satisfy their individual needs, which in the future inevitably leads to the moral depreciation of the law and its perception by society as an empty and unnecessary formality. In addition, the problem of the forensic characterization of bribery also remains current and requires theoretical research. Determining the specifics of the conditions for committing bribery served as the relevance of the choice of topic. The conclusions and proposals are aimed at improving criminal legislation on combating bribery.
