Принцип незалежності у сфері фінансового контролю

Abstract

У публікації звертається увага на важливість незалежності як принципу діяльності органів фінансового контролю та його посадових осіб. У роботі розкривається зміст принципу незалежності як одного з гарантів законності під час здійснення фінансового контролю. Аналіз наукових позицій дозволив виокремити відповідні критерії для поділу характеристик принципу незалежності. Проведено аналіз міжнародної нормативно-правової бази, в якій закріплено принцип незалежності у сфері фінансового контролю, чим визначається його важливість. При цьому міжнародне законодавство розкриває зміст основних положень даного принципу, що може стати прикладом реалізації зазначених положень у чинне законодавство України.

The publication draws attention to the importance of independence as a principle of activity of financial control bodies and its officials. The paper reveals the content of the principle of independence as one of the guarantees of legality in the exercise of financial control. The analysis of scientific positions allowed to single out the relevant criteria for separating the characteristics of the principle of independence. An analysis of the international legal framework in which the principle of independence in the field of financial control is enshrined, which determines its importance. At the same time, international law reveals the content of the main provisions of this principle, which can be an example of the implementation of these provisions in the current legislation of Ukraine.
