Актуальні питання захисту прав споживачів

Abstract

Стаття присвячена дослідженню актуальних питань захисту прав споживачів, що є важливим аспектом у контексті сучасного споживчого ринку. У роботі аналізуються основні проблеми, з якими стикаються споживачі в Україні, такі як порушення гарантійних зобов’язань з боку продавців, а також труднощі, пов’язані з проведенням незалежної експертизи для підтвердження факту неналежної якості товару. Розглядаються механізми, які встановлені законодавством для захисту прав споживачів, включаючи право на повернення товару, вимогу заміни товару, зменшення вартості товару, безоплатне усунення недоліків, а також можливість отримання компенсації за товар неналежної якості. Крім того, стаття досліджує роль державних органів у сфері захисту прав споживачів, які забезпечують реалізацію державної політики щодо захисту прав споживачів, а також їх роль у забезпеченні належного захисту прав споживачів, зокрема через проведення перевірок та накладання санкцій на порушників. Стаття звертає увагу на проблеми, що виникають у процесі торгівлі в інтернет просторі, де питання захисту прав споживачів набувають особливої гостроти через складність комунікації між споживачем та продавцем, а також обговорюються питання адаптації національного законодавства до міжнародних стандартів та практик у сфері захисту прав споживачів, що є важливим у контексті інтеграції України до європейського правового простору. На основі проведеного аналізу висвітлюються основні актуальні питання, проблеми та рекомендації щодо удосконалення механізмів захисту прав споживачів, зокрема шляхом посилення контролю за дотриманням законодавства, поліпшення інформування споживачів та розширення можливостей для ефективного вирішення спорів.

The article is devoted to the study of current issues of consumer rights protection, which is an important aspect in the context of the modern consumer market. The paper analyzes the main problems faced by consumers in Ukraine, such as the violation of warranty obligations by sellers, as well as the difficulties associated with conducting an independent examination to confirm the fact of inadequate product quality. Mechanisms established by legislation for the protection of consumer rights are considered, including the right to return the product, the requirement to replace the product, reduce the cost of the product, eliminate defects free of charge, as well as the possibility of receiving compensation for the product of inadequate quality. In addition, the article examines the role of state bodies that ensure the implementation of state policy on the protection of consumer rights, as well as their role in ensuring the proper protection of consumer rights, in particular through inspections and the imposition of sanctions on violators. The article draws attention to the problems that arise in the process of trading in the Internet space, where issues of consumer rights protection become especially acute due to the complexity of communication between the consumer and the seller, and also discusses the issue of adapting national legislation to international standards and practices in the field of consumer rights protection, which is important in the context of Ukraine's integration into the European legal space. Based on the analysis, the main current issues, problems and recommendations regarding the improvement of consumer rights protection mechanisms are highlighted, in particular by strengthening control over compliance with legislation, improving consumer information and expanding opportunities for effective dispute resolution.
