Адміністративна відповідальність за правопорушення у сфері земельних відносин

Abstract

Дисертація присвячена комплексному дослідженню теоретичних та правових засад регулювання адміністративної відповідальності за правопорушення у сфері земельних відносин. З цією метою наведено: характеристику земельних відносин, етапи їх становлення через закріплення в нормативно-правових актах та реформу органів управління. Встановлено адміністративні проступки, що вчиняються у сфері земельних відносин, як підстави адміністративної відповідальності; визначено їх головні ознаки та склад, що дає можливість їх правильної кваліфікації. Доведено, що лише адміністративне стягнення є мірою відповідальності за адміністративний проступок. Запропоновано, поряд з підвищенням розміру штрафу, запровадити громадські роботи як вид адміністративного стягнення, накладення яких покласти на суди, а їх виконання - на кримінально- та адміністративно-виконавчу інспекцію на засадах організації діяльності служб пробації, яку створити у структурі Міністерства юстиції України як державний орган. Запропоновано відповідні зміни та доповнення до Кодексу України про адміністративні правопорушення, Земельного кодексу України.

The dissertation is devoted to integral study of theoretical and legal foundations of the regulation of administrative responsibility for violations in the field of land relationships. To this objective, the work contains: characteristics of land relationships, stages of their formation through fixing in legal and regulatory acts and through the reform of authoritative bodies. Administrative misconducts are determined which are found in the field of land relationships, that give ground for administrative responsibility; as well as their main indications and composition are specified that enables the possibility to correctly qualify them. It is proved that only administrative penalty is the relevant measure of responsibility for administrative misconduct. Along with increasing the amount of fines, the public works are proposed as well, being a kind of administrative penalty, and its imposition shall be assigned to courts, while their implementation shall be conferred to criminal and administrative executive inspectorate (whose functioning shall be implemented on the organizational basis of the probation services), the latter being created within the structure in the Ministry of Justice as an agency of public authority. Certain relevant changes and additions to the Ukrainian Code of administrative violations, and to the Ukrainian Land Code are proposed as well.
