Склад суду у справах за позовами про захист прав невизначеного кола осіб та ефективність судового процесу

Abstract

Тези присвячено визначенню складу суду у справах за позовами про захист прав невизначеного кола осіб та ефективності судового процесу. Обґрунтовано, що одноособовий склад суду не завжди може гарантувати належний рівень обґрунтованості та, як наслідок, стабільності судового рішення у справах за позовами про захист прав невизначеного кола осіб. У зв’язку із цим актуальними є дослідження щодо запровадження колегіального складу суду для розгляду вказаних справ у судах першої інстанції у складі трьох професійних суддів. The thesis is devoted to the definition of the composition of the court in cases of claims for the protection of the rights of an indeterminate number of persons and the effectiveness of the court process. It is substantiated that an individual court composition cannot always guarantee the proper level of validity and, as a consequence, the stability of a court decision in cases of claims for the protection of the rights of an uncertain circle of persons. In this regard, studies on the introduction of a collegiate court for consideration of these cases in the courts of first instance, consisting of three professional judges, are relevant.
