Вирішення спорів про участь у вихованні дитини в порядку цивільного судочинства

Abstract

У статті на підставі аналізу судової практики встановлено, що найбільшу групу спорів про участь у вихованні дитини становлять спори щодо: визначення порядку участі у вихованні дитини та про усунення перешкод у спілкуванні з нею для одного з батьків; визначення порядку участі у вихованні дитини та про усунення перешкод у спілкуванні з нею для баби / діда; зміни порядку участі у вихованні дитини. Встановлено, що предметом спорів є невиконання зобов’язань матері дитини повідомляти батька про важливі факти про життя дитини. Окремо звернуто увагу на процесуальні питання у справах про визначення порядку участі у вихованні дитини. З’ясовано, що звернення особи до суду з позовом, однією з вимог якого є визначення способу та порядку участі у вихованні дитини шляхом встановлення відповідного графіка, а також із заявою про забезпечення позову щодо побачень та спілкувань (контактів) із дитиною, тотожні між собою, а тому вжиття заходів забезпечення позову із заявленими позовними вимогами не допускається. Встановлено, що у справах за позовом одного з батьків про визначення способів участі у вихованні дитини і спілкуванні з нею належним відповідачем є інший із батьків, а не орган опіки та піклування.

The article, based on the analysis of court practice, found that the largest group of disputes about participation in the upbringing of a child are disputes regarding: determining the order of participation in the upbringing of a child and removing obstacles in communication with it for one of the parents; determination of the order of participation in the upbringing of the child and the elimination of obstacles in communication with the grandmother / grandfather; changes in the order of participation in raising a child. It has been established that the subject of the dispute is the failure of the child’s mother to inform the father of important facts about the child’s life. Particular attention is paid to procedural issues in cases concerning the determination of the procedure for participation in a child's upbringing. It has been established that a lawsuit seeking to define the manner and procedure for participating in a child’s upbringing – by establishing a specific schedule – is identical in substance to an application for interim relief (securing the claim) regarding visitation and communication (contact) with the child; therefore, the granting of interim relief that mirrors the claims asserted in the lawsuit is not permitted.
