| dc.description.abstract | Стаття присвячена висвітленню законодавчих новацій щодо визначення оригінальності твору як об’єкта авторського права, визначенню перспектив їх реалізації у науковій та правозастосовній сферах. Надано оцінку законодавчої дефініції оригінальності твору в пункту 35 статті 1 Закону України «Про авторське право і суміжні права» у контексті імплементації норм законодавства ЄС у національне законодавство. Стверджується, що оригінальність твору закріплена як критерій охороноздатності твору. Обґрунтовано існування у національній системі захисту авторського права «презумпції оригінальності» літературних і художніх творів. The article is devoted to the coverage of legislative innovations regarding the determination of the originality of a work as an object of copyright, the determination of prospects for their implementation in the scientific and law enforcement spheres. An assessment of the legislative definition of the originality of the work in paragraph 35 of Article 1 of the Law of Ukraine "On Copyright and Related Rights" in the context of the implementation of EU legislation into national legislation is given. It is claimed that the originality of the work is established as a criterion for the protectionability of the work. The existence of the "presumption of originality" of literary and artistic works in the national copyright protection system is substantiated. | |
