Забезпечення та захист прав у органах фінансового контролю за новою адміністративною процедурою

Abstract

У публікації висвітлюється питання щодо вдосконалення порядку оскарження рішень та дій органів фінансового контролю. Розкриваються положення основних принципів, на яких базується процес оскарження. Звертається увага, що на законодавчому рівні на контролюючий орган покладено обов’язок встановлювати обставини, що мають значення для вирішення справи, і за потреби збирати для цього документи та інші докази з власної ініціативи. Розглядаються процедурні дії та рішення, які можуть бути оскаржені до прийняття органом фінансового контролю рішення, а також ті, оскарження яких відбувається вже після його прийняття.

The publication covers the issue of improving the procedure for appealing against decisions and actions of financial control bodies. The provisions of the basic principles on which the appeal process is based are disclosed. It is noted that at the legislative level, the controlling authority is obliged to establish the circumstances relevant to the resolution of the case and, if necessary, to collect documents and other evidence on its own initiative. The author examines the procedural actions and decisions that may be appealed before the financial control body makes a decision, as well as those that may be appealed after the decision has been made.
