Напрями вдосконалення конституційно-правового статусу Вищої ради юстиції

Abstract

В статті розглянуто проблемні аспекти формування та реалізації повноважень такого конституційного органу України як Вища рада юстиції. В контексті міжнародних стандартів у сфері судочинства та рекомендацій європейських інституцій запропоновано зміни до Основного Закону України, що посилять інституційну спроможність Вищої ради юстиції щодо формування неупередженого суддівського корпусу та забезпечення гарантій його незалежності при здійсненні правосуддя.The article deals with the problem of forming and implementing powers of such constitutional authority of Ukraine as the High Council of Justice. It was proposed changes to the Constitution of Ukraine according to the international standards in the field of justice and the recommendations of the European institutions. These changes will strengthen the institutional capacity of the High Council of Justice on the formation of an impartial judiciary and guarantee its independence in the administration of justice.
