Порівняльна історія права: вітчизняна традиція концептуалізації

Abstract

The monograph examines the processes of formation and development of domestic tradition conceptualization of the comparative history of law. The author based on a comprehensive and systematic elaboration of the works proved that the integrity of the tradition was based on unification of views, ideas, ideas of scholars on the essence of the comparative history of law. The variability of scholars' understanding of the comparative history of law reflected the following scientific ones phenomena of social reality as the formation of its "image" by representatives of the historical schools of law in Ukraine in the second half of the XIX century, conceptualization within the socio- positivist direction, focusing on specific comparative and historical toric legal research in the works of Ukrainian scholars abroad in the 20s - 80s of the twentieth century.
