Сучасний стан захисту авторського права від плагіату в мережі інтернет

Abstract

Проаналізовано особливості правового регулювання та захисту авторського права, а також висвітлено питання захисту авторського права від плагіату в мережі Інтернет, на підставі чого були запропоновані шляхи вдосконалення національного законодавства у сфері авторських та суміжних прав. The modern stage of the development of the information society makes for the sphere of copyright a dual infl uence both positive and negative. The most violations on the Internet in recent years have become acute, because there is a violation of rights, that is, downloading objects copyright and related rights without payment of the appropriate remuneration. Among the diversity of copyright violations there are off enses of a transnational character, the struggle with which is relevant for any country - plagiarism, and the peculiarities of copyright protection in the Internet network, are still poorly researched, which indicates the relevance of the chosen subject. The purpose of the article is to study the current state of protection of copyright from plagiarism on the Internet, and on the basis of an analysis of the provision of proposals for the improvement of Ukrainian legislation. Civil law protection of intellectual property rights from plagiarism consists in applying the methods provided for by the current legislation to stop the violation, restoration of violated rights of rightholders, and bringing the perpetrators to responsibility for the appropriation of authorship. Taking into account the development of modern technologies, and the current state of aff airs, at the legislative level, it is necessary to develop and, accordingly, to adopt, a separate law on the protection of copyright in the Internet, in which to defi ne the peculiarities of the regulation and enforcement of copyright rights on the Internet; the peculiarities of proving violation of rights in the «virtual network» and introducing new adapted to the peculiarities of the relations arising in the fi eld of its functioning, the mechanisms for the enforcement of intellectual property rights.
