Окремі аспекти міжнародного досвіду здійснення безмитної торгівлі

Abstract

In the article investigated of current international trends of Duty-free Trade functioning to finding of optimal ways of improving of this field of social and economic relationships in Ukraine. The authors found out that current international trends of development of Duty-free Trade could be represented by two models – European-oriented and Asian-oriented. The first one is represented by law and regulation providing and practice of implementing of Duty-free Trade in European Union, and the second one – in European and Asian Economic Union. Fundamental difference between these models includes such provision as: gradual refusal of EU from Duty-free Trade as from Transition Customs Regime whereas EAEU expands scale of Duty-free Trade as Customs Procedure. There is grounded that Ukraine has to take account special features of implementing of Duty-free Trade in both international formations that are analyzed by authors, therewith to embrace its' own way of development of Duty-free Trade, that would be the most appropriate to protect national interests. The analysis of international law and regulation provision and practice in the field of Duty-free Trade is carried out. As a result, the fundamental deference between European-oriented and Asian-oriented models of Duty-free Trade is formed. Moreover, there is suggested to take account into domestic experience the most rational elements of both models, and to form own Ukrainian practice of implementing of Duty-free Trade with priority of national interests.
