Abstract

This article explores some of the problematic aspects encountered by law enforcement agents in bringing to justice the perpetrators of the creation of illegal paramilitary and armed formations. The institute of criminal responsibility for acts connected with the operation of illegal paramilitary formations was investigated. The correlation between the concepts of "paramilitary formation" and "armed formations" is considered. The revealed factors contributing to the occurrence on the territory of Ukraine of illegal paramilitary and armed formations. The generic and immediate objects, the object, the objective and subjective side, the subject of the crime are determined. The proposals on improving the c.260 of the Criminal Code of Ukraine are presented.
